The Battle before the Battle for Eretz Yisrael

1.   רמב"ן שמות הקדמה
והנה הגלות איננו נשלם עד יום שובם אל מקומם ואל מעלת אבותם ישובו. וכשיצאו ממצרים אף על פי שיצאו מבית עבדים עדיין יחשבו גולים כי היו בארץ לא להם נבוכים במדבר וכשבאו אל הר סיני ועשו המשכן ושב הקדוש ברוך הוא והשרה שכינתו ביניהם אז שבו אל מעלות אבותם שהיה סוד אלוה עלי אהליהם והם הם המרכבה ואז נחשבו גאולים ולכן נשלם הספר הזה בהשלימו ענין המשכן ובהיות כבוד ה' מלא אותו תמיד: 
2.   רמב"ן שמות פרק כה פסוק ב
וסוד המשכן הוא, שיהיה הכבוד אשר שכן על הר סיני שוכן עליו בנסתר. 
3.    שמות פרק יז, 
(ז) וַיִּקְרָא֙ שֵׁ֣ם הַמָּק֔וֹם מַסָּ֖הוּמְרִיבָ֑ה עַל־רִ֣יב׀ בְּנֵ֣י יִשְׂרָאֵ֗ל וְעַ֨ל נַסֹּתָ֤םאֶת־ה֙' לֵאמֹ֔ר הֲיֵ֧שׁ ה֛' בְּקִרְבֵּ֖נוּ אִם־אָֽיִן: פ (ח) וַיָּבֹ֖א עֲמָלֵ֑ק וַיִּלָּ֥חֶם עִם־יִשְׂרָאֵ֖ל בִּרְפִידִֽם: (ט) וַיֹּ֨אמֶר מֹשֶׁ֤ה אֶל־יְהוֹשֻׁ֙עַ֙ בְּחַר־לָ֣נוּ אֲנָשִׁ֔ים וְצֵ֖א הִלָּחֵ֣ם בַּעֲמָלֵ֑ק מָחָ֗ר אָנֹכִ֤י נִצָּב֙ עַל־רֹ֣אשׁ הַגִּבְעָ֔ה וּמַטֵּ֥ה הָאֱלֹהִ֖ים בְּיָדִֽי: (י) וַיַּ֣עַשׂ יְהוֹשֻׁ֗עַ כַּאֲשֶׁ֤ר אָֽמַר־לוֹ֙ מֹשֶׁ֔ה לְהִלָּחֵ֖ם בַּעֲמָלֵ֑ק וּמֹשֶׁה֙ אַהֲרֹ֣ן וְח֔וּר עָל֖וּ רֹ֥אשׁ הַגִּבְעָֽה: (יא) וְהָיָ֗ה כַּאֲשֶׁ֨ר יָרִ֥ים מֹשֶׁ֛ה יָד֖וֹוְגָבַ֣ר יִשְׂרָאֵ֑ל וְכַאֲשֶׁ֥ר יָנִ֛יחַ יָד֖וֹ וְגָבַ֥ר עֲמָלֵֽק: (יב) וִידֵ֤י מֹשֶׁה֙ כְּבֵדִ֔ים וַיִּקְחוּ־אֶ֛בֶן וַיָּשִׂ֥ימוּ תַחְתָּ֖יו וַיֵּ֣שֶׁבעָלֶ֑יהָ וְאַהֲרֹ֨ן וְח֜וּר תָּֽמְכ֣וּ בְיָדָ֗יו מִזֶּ֤ה אֶחָד֙ וּמִזֶּ֣ה אֶחָ֔ד וַיְהִ֥י יָדָ֛יו אֱמוּנָ֖העַד־בֹּ֥א הַשָּֽׁמֶשׁ: (יג) וַיַּחֲלֹ֧שׁ יְהוֹשֻׁ֛עַ אֶת־עֲמָלֵ֥ק וְאֶת־עַמּ֖וֹ לְפִי־חָֽרֶב: פ        (יד) וַיֹּאמֶר ה' אֶל מֹשֶׁה כְּתֹב זֹאת זִכָּרוֹן בַּסֵּפֶר וְשִׂים בְּאָזְנֵי יְהוֹשֻׁעַ כִּי מָחֹה אֶמְחֶה אֶת זֵכֶר עֲמָלֵק מִתַּחַת הַשָּׁמָיִם: (טו) וַיִּבֶן מֹשֶׁה מִזְבֵּחַ וַיִּקְרָא שְׁמוֹ ה' נִסִּי: (טז) וַיֹּאמֶר כִּי יָד עַל כֵּס יָהּ מִלְחָמָה לה' בַּעֲמָלֵק מִדֹּר דֹּר: פ
7 The place was named Massah and Meribah, because the Israelites quarreled and because they tried the LORD, saying, “Is the LORD present among us or not?”8 Amalekcame and fought with Israel at Rephidim. 9 Moses said to Joshua, “Pick some men for us, and go out and do battle with Amalek. Tomorrow I will station myself on the top of the hill, with the rod of God in my hand.” 10 Joshua did as Moses told him and fought with Amalek, while Moses, Aaron, and Hur went up to the top of the hill. 11 Then, whenever Moses held up his hand, Israel prevailed; but whenever he let down his hand, Amalek prevailed. 12 But Moses’ hands grew heavy; so they took a stone and put it under him and he sat on it, while Aaron and Hur, one on each side, supported his hands; thus his hands remained steady until the sun set. 13 And Joshua overwhelmed the people of Amalek with the sword.
14 And the Lord said to Moshe, Write this for a memorial in a book, and recite it in the ears of Joshua; for I will completely put out the remembrance of Amalek from under heaven15 And Moses built an altar, and called its name Adonai-Nissi;16 For he said, Because the Lord has sworn by His throne (kes) that the Lord will have war with Amalek from generation to generation.
4.    דברים פרק כה, יז-יט
(יז) זָכ֕וֹר אֵ֛ת אֲשֶׁר־עָשָׂ֥ה לְךָ֖ עֲמָלֵ֑ק בַּדֶּ֖רֶךְ בְּצֵאתְכֶ֥ם מִמִּצְרָֽיִם: (יח) אֲשֶׁ֨ר קָֽרְךָ֜ בַּדֶּ֗רֶךְ וַיְזַנֵּ֤ב בְּךָ֙ כָּל־הַנֶּחֱשָׁלִ֣ים אַֽחֲרֶ֔יךָ וְאַתָּ֖ה עָיֵ֣ףוְיָגֵ֑עַ וְלֹ֥א יָרֵ֖א אֱלֹהִֽים: (יט) וְהָיָ֡ה בְּהָנִ֣יחַ ה֣' אֱלֹהֶ֣יךָ׀ לְ֠ךָ מִכָּל־אֹ֨יְבֶ֜יךָ מִסָּבִ֗יב בָּאָ֙רֶץ֙ אֲשֶׁ֣ר הֽ'־אֱ֠לֹהֶיךָ נֹתֵ֨ן לְךָ֤ נַחֲלָה֙ לְרִשְׁתָּ֔הּ תִּמְחֶה֙ אֶת־זֵ֣כֶר עֲמָלֵ֔ק מִתַּ֖חַת הַשָּׁמָ֑יִם לֹ֖א תִּשְׁכָּֽח: פ
Remember what Amalek did to you on your journey, after you left Egypt—18 how, undeterred by fear of God, he surprised you on the march, when you were tiredand weary, and cut down all the stragglers in your rear.19 Therefore, when the LORD your God grants you safety from all your enemies around you, in the land that the LORD your God is giving you as a hereditary portion, you shall blot out the memory of Amalek from under heaven. Do not forget!
5.    דברים פרק כה, טו-טז
(טו) אֶ֣בֶן שְׁלֵמָ֤ה וָצֶ֙דֶק֙ יִֽהְיֶה־לָּ֔ךְ אֵיפָ֧ה שְׁלֵמָ֛ה וָצֶ֖דֶק יִֽהְיֶה־לָּ֑ךְ לְמַ֙עַן֙ יַאֲרִ֣יכוּ יָמֶ֔יךָ עַ֚ל הָֽאֲדָמָ֔ה אֲשֶׁר־ה֥' אֱלֹהֶ֖יךָ נֹתֵ֥ן לָֽךְ: (טז) כִּ֧י תוֹעֲבַ֛ת ה֥' אֱלֹהֶ֖יךָ כָּל־עֹ֣שֵׂה אֵ֑לֶּה כֹּ֖ל עֹ֥שֵׂה עָֽוֶל: פ
But you shall have a perfect and just weight, a perfect and just measure shall you have; that your days may be lengthened in the land which the Lord your God gives you. For all who do such things, and all who do unrighteously, are an abomination to the Lord your God.


6.    חזקוני שמות פרשת בשלח פרק יז פסוק ח
וילחם עם ישראל מפני שנאת מכירת הבכורה אבל מקודם לכן נתייראו להזדווג אליהם שלא יהא מוטל עליהם פריעת שטר החוב של ועבדום וענו אותם ד' מאות שנה.
7.   דעת זקנים מבעלי התוספות שמות פרשת בשלח פרק יז פסוק ח
(ח) ויבא עמלק. תמה למה איחר להלחם עם ישראל עד עכשיו ולא בא מיד שירדו למצרים שלא היו כי אם שבעים נפש. י"ל שאמר לו הקדוש ברוך הוא לאברהם ועבדום וענו אותם. וכשמת אבינו אברהם ע"ה הטיל החוב על יצחק. וכשמת יצחק הוטל על יעקב ובניו ועשו ובניו ואמר עמלק הרשע בלבו אם אכרית את יעקב וזרעו יהיה החוב מוטל עלי לכך המתין עד שיצאו ממצרים שכבר נפרע החוב ואז בא להלחם עמהן:
8.   מכילתא דרבי ישמעאל בשלח - מסכתא דעמלק פרשה א 
איסי בן יהודה אומר חמשה דברים יש שאין להם בתורה הכרע ... מָחָ֗ר אָנֹכִ֤י נִצָּב֙ עַל־רֹ֣אשׁ הַגִּבְעָ֔האוצֵ֖א הִלָּחֵ֣ם בַּעֲמָלֵק מָחָ֗ר...
9.   רש"י דברים פרשת כי תצא פרק כה פסוק יח 
כָּל־הַנֶּחֱשָׁלִים אַֽחֲרֶיךָ -חסרי כח מחמת חטאם, שהיה הענן פולטן:
וְאַתָּה עָיֵףוְיָגֵעַ - עיף בצמא, דכתיב (שמות יז ג) ויצמא שם העם למים, וכתיב אחריו ויבא עמלק:וְיָגֵעַ- בדרך:וְלֹא יָרֵא עמלק, אלקים, מלהרע לך:
10.פירוש הרא"ש על התורה דברים פרשת כי תצא פרק כה פסוק יח 
ולא ירא אלהים. פירש"י אעמלק ולא קאי אישראלולא ירא אלהים במשקולות ולכך נסמכה לפ' לא יהי בכיסך וזהו שארז"ל נאמר מורא במשקלות ולפי שלא קיימו המורא במשקלות דכתי' ביה ויראת מאלהיך לכך בא עמלק זש"ה מאזני מרמה תועבת ה' וכתיב בתריה בא זדון ויבוא קלון וגם כתיב כאן כי תועבת ה' כל עושה אלה:
11.בראשית פרק כה, כט-לד
(כט) וַיָּ֥זֶד יַעֲקֹ֖ב נָזִ֑יד וַיָּבֹ֥א עֵשָׂ֛ו מִן־הַשָּׂדֶ֖ה וְה֥וּא עָיֵֽף: (ל) וַיֹּ֨אמֶר עֵשָׂ֜ו אֶֽל־יַעֲקֹ֗ב הַלְעִיטֵ֤נִי נָא֙ מִן־הָאָדֹ֤ם הָאָדֹם֙ הַזֶּ֔ה כִּ֥י עָיֵ֖ףאָנֹ֑כִי עַל־כֵּ֥ן קָרָֽא־שְׁמ֖וֹ אֱדֽוֹם: (לא) וַיֹּ֖אמֶר יַעֲקֹ֑ב מִכְרָ֥ה כַיּ֛וֹם אֶת־בְּכֹֽרָתְךָ֖לִֽי: (לב) וַיֹּ֣אמֶר עֵשָׂ֔ו הִנֵּ֛ה אָנֹכִ֥י הוֹלֵ֖ךְ לָמ֑וּת וְלָמָּה־זֶּ֥ה לִ֖י בְּכֹרָֽה: (לג) וַיֹּ֣אמֶר יַעֲקֹ֗ב הִשָּׁ֤בְעָה לִּי֙ כַּיּ֔וֹם וַיִּשָּׁבַ֖ע ל֑וֹ וַיִּמְכֹּ֥ר אֶת־בְּכֹרָת֖וֹ לְיַעֲקֹֽב: (לד) וְיַעֲקֹ֞ב נָתַ֣ן לְעֵשָׂ֗ו לֶ֚חֶם וּנְזִ֣יד עֲדָשִׁ֔ים וַיֹּ֣אכַל וַיֵּ֔שְׁתְּ וַיָּ֖קָם וַיֵּלַ֑ךְ וַיִּ֥בֶז עֵשָׂ֖ו אֶת־הַבְּכֹרָֽה: ס
Once when Jacob was cooking a stew, Esau came in from the open, tired.30 And Esau said to Jacob, “Give me some of that red stuff to gulp down, for I am tired”—which is why he was named Edom. 31 Jacob said, “First sell me your birthright.” 32 And Esau said, “I am at the point of death, so of what use is my birthright to me?” 33 But Jacob said, “Swear to me first.” So he swore to him, and sold his birthright to Jacob. 34 Jacob then gave Esau bread and lentil stew; he ate and drank, and he rose and went away. Thus did Esau spurn the birthright.
12.אבן עזרא - הפירוש הקצר שמות פרשת בשלח פרק יז פסוק ט 
אנכי נצב. על דעתי כי זאת הגבעה הוא הצור שהכה והוא הר סיני. ואל יקשה עליך שאמר הכתוב שנסעו מרפידים ובאו אל מדבר סיני (שמות יט, ב), כי מחנה גדול היה, וראש מסע שני בסוף מסע ראשון או קרוב ממנו, או הר סיני קרוב משניהם:
13.סדר עולם רבה (ליינר) פרק ה
שנאמר ויסעו מאילם ויבאו כל עדת בני ישראל אל מדבר סין (שמות טז א) (והוא אלוש) בחמשה עשר יום לחדש השני לצאתם מארץ מצרים (שם /שמות ט"ז, א/), ואחד בשבת היה, הא למדנו שראש חדש אייר באחד בשבת היה, ועוד למדנו שהיו ישראל אוכלין מעוגה שהוציאו בידם ממצרים כל שלשים יום, ובו ביום כלתה, ולערב אכלו את השליו ולמשכים לקטו את המן, ובאלוש נתנה להם השבת, ושם עשו שבת ראשונה, שנאמר וישבתו העם ביום השבעי (שם /שמות/ טז ל), באחד בשבת בכ"ג באייר נסעו מאלוש ובאו להם לרפידים, ושם נתנה להם הבאר ונלחמו עם עמלק ושם עשו שבת שניה

14.ירמיהו פרק ג פסוק יז
בָּעֵת הַהִיא יִקְרְאוּ לִירוּשָׁלִַם כִּסֵּא ה'וְנִקְווּ אֵלֶיהָ כָל הַגּוֹיִם לְשֵׁם ה' לִירוּשָׁלִָם וְלֹא יֵלְכוּ עוֹד אַחֲרֵי שְׁרִרוּת לִבָּם הָרָע: ס 
At that time they shall call Jerusalem the throne of the Lord; and all the nations shall be gathered to it, to the name of the Lord, to Jerusalem; nor shall they walk any more after the stubbornness of their evil heartYirmiyahu 3:17
15.מדרש תנחומא (ורשא) פרשת תצוה סימן ט
דָּבָר אַחֵר: כָּבוֹד חֲכָמִים יִנְחָלוּ, זֶה יְהוֹשֻׁעַ, שֶׁיָּרַשׁ כָּבוֹד מִמֹּשֶׁה רַבֵּנוּ, שֶׁאָמַר לוֹ הַקָּדוֹשׁ בָּרוּךְ הוּא, כַּאֲשֶׁר הָיִיתִי עִם מֹשֶׁה אֶהְיֶה עִמָּךְ (יהושע א, ה). לְמֹשֶׁה אָמַר לוֹ הַקָּדוֹשׁ בָּרוּךְ הוּא: שַׁל נְעָלֶיךָ מֵעַל רַגְלֶיךָ (שמות ג, ה). וְלִיהוֹשֻׁעַ וַיֹּאמֶר שַׂר צָבָא ה' אֶל יְהוֹשֻׁעַ שַׁל נַעַלְךָ מֵעַל רַגְלֶךָ (יהושע ה, טו). מֹשֶׁה כָּתוּב בּוֹ: אָז יָשִׁיר מֹשֶׁה וּבְנֵי יִשְׂרָאֵל (שמות טו, א). וִיהוֹשֻׁעַ, אָז יְדַבֵּר יְהוֹשֻׁעַ לַה' בְּיוֹם תֵּת ה' (יהושע י, יב). מֹשֶׁה הוֹצִיאָם מִמִּצְרַיִם, וִיהוֹשֻׁעַ הִכְנִיסָם לָאָרֶץ. מֹשֶׁה הָרַג לְסִיחוֹן וְעוֹג, וִיהוֹשֻׁעַ שְׁלֹשִים וְאֶחָד מְלָכִים. מֹשֶׁה הֶעֱמִיד גַּלְגַּל חַמָּה בְּמִלְחֶמֶת עֲמָלֵק, שֶׁנֶּאֱמַר: וְהָיָה כַּאֲשֶׁר יָרִים מֹשֶׁה (שמות יז, יא). וְאֵין יָרִים אֶלָּא לָשׁוֹן שֶׁהֶעֱמִיד גַּלְגַּל חַמָּה, שֶׁנֶּאֱמַר: נָתַן תְּהוֹם קוֹלוֹ רוֹם יָדֵיהוּ נָשָׂא (חבקוק ג, י). וִיהוֹשֻׁעַ כֵּן, שֶׁנֶּאֱמַר: שֶׁמֶשׁ בְּגִבְעוֹן דּוֹם וְיָרֵחַ בְּעֵמֶק אַיָּלוֹן (יהושע י, יב). מֹשֶׁה בָּנָה מִזְבֵּחַ, שֶׁנֶּאֱמַר: וַיִּבֶן מֹשֶׁה מִזְבֵּחַ (שמות יז, טו). וִיהוֹשֻׁעַ כֵּן: שֶׁנֶּאֱמַר (יהושע ח, ל) אָז יִבְנֶה יְהוֹשֻׁעַ מִזְבֵּחַ, מֹשֶׁה כָּתַב אֶת הַתּוֹרָה שֶׁנֶּאֱמַר: וַיִּכְתֹּב מֹשֶׁה אֶת הַתּוֹרָה הַזֹּאת (דברים לא, ט), וִיהוֹשֻׁעַ כֵּן וַיִּכְתֹּב יְהוֹשֻׁעַ אֶת הַדְּבָרִים הָאֵלֶּה בְּסֵפֶר תּוֹרַת אֱלֹהִים (יהושע כד, כו). הֲרֵי בַּכֹּל.
16.רש"י מסכת תענית דף טז עמוד א
חד אמר הר שיצא הוראה- תורה לישראל כי מציון תצא תורה (ישעיה ב), יורו משפטיך ליעקב (דברים לג), ולשכת הגזית שבה עמדו הנביאים המוכיחים לישראל.
מורא לאומות העולם- ששומעין גדולות ישראל וירושלים ומתפחדים עליהם, שמעתי,לישנא אחרינא: הר המוריה - הר סיני, מורא לאומות העולם - במתן תורה, דכתיב (תהלים עו)אֶ֖רֶץ יָֽרְאָ֣ה וְשָׁקָֽטָה.
17.מדרש תהלים (שוחר טוב; בובר) מזמור סח
וסיני מהיכן בא, אמר ר' יוסי מהר המוריה נתלש, כחלה מעיסה, ממקום שנעקד יצחק אבינו, אמר הקדוש ברוך הוא הואיל ויצחק אביהם נעקד עליו נאה לבניו לקבל עליו את התורה, ומניין שעתיד לחזור למקומו, שנאמר נכון יהיה הר בית ה' בראש ההרים (ישעיה ב ב), אלו תבור וכרמל וסיני וציון, ההרים. ה' הרים, כלומר כמנין חמשה חומשי תורה.

(א) הַדָּבָר֙ אֲשֶׁ֣ר חָזָ֔ה יְשַֽׁעְיָ֖הוּ בֶּן־אָמ֑וֹץ עַל־יְהוּדָ֖ה וִירוּשָׁלִָֽם: (ב) וְהָיָ֣ה׀ בְּאַחֲרִ֣ית הַיָּמִ֗ים נָכ֨וֹן יִֽהְיֶ֜ה הַ֤ר בֵּית־ה֙' בְּרֹ֣אשׁ הֶהָרִ֔ים וְנִשָּׂ֖א מִגְּבָע֑וֹת וְנָהֲר֥וּ אֵלָ֖יו כָּל־הַגּוֹיִֽם: (ג) וְֽהָלְכ֞וּ עַמִּ֣ים רַבִּ֗ים וְאָמְרוּ֙ לְכ֣וּ׀ וְנַעֲלֶ֣ה אֶל־הַר־ה֗' אֶל־בֵּית֙ אֱלֹהֵ֣י יַעֲקֹ֔ב וְיֹרֵ֙נוּ֙ מִדְּרָכָ֔יו וְנֵלְכָ֖ה בְּאֹרְחֹתָ֑יו כִּ֤י מִצִּיּוֹן֙ תֵּצֵ֣א תוֹרָ֔ה וּדְבַר־ה֖' מִירוּשָׁלִָֽם: (ד) וְשָׁפַט֙ בֵּ֣ין הַגּוֹיִ֔ם וְהוֹכִ֖יחַ לְעַמִּ֣ים רַבִּ֑ים וְכִתְּת֨וּ חַרְבוֹתָ֜ם לְאִתִּ֗ים וַחֲנִיתֽוֹתֵיהֶם֙ לְמַזְמֵר֔וֹת לֹא־יִשָּׂ֨א ג֤וֹי אֶל־גּוֹי֙ חֶ֔רֶב וְלֹא־יִלְמְד֥וּ ע֖וֹד מִלְחָמָֽה: פ

The Sinai Experience

The most familiar verse in the Torah is the oft-repeated “And God spoke to Moshe,” appearing some 75 times; occasionally, a location is added to give context to a particular communication. For the most part, though, other than the first verse of the book, Vayikra has been devoid of geographic or chronological references, which serves to make the opening verse of Parashat B’har, the penultimate parashah of Vayikra, even more eye-catching: “And God spoke to Moshe at Mount Sinai…” Why, at this particular juncture, is Sinai mentioned?

The verses that follow this anomalous introduction are an expansion of the laws of the sabbatical year, which appeared earlier, albeit in abbreviated form, in the book of Shmot. In the iteration here in Parashat B'har, the sabbatical year serves as an introduction to the laws of the jubilee: Every seventh year the land must lay fallow, reminding the farmer that ultimately, everything is owned by God.  At the conclusion of seven sabbatical cycles, in the fiftieth or jubilee year, land returns to its ancestral owners, and the cycle begins again. If the original owner of the land is deceased, we are commanded to call upon the relatives of the deceased in order to fulfill the requirements of the jubilee cycle. In this context, the prohibition of usury is introduced: 

If your brotheris in a dire situation…do not exact from him advance or accrued interest; fear your God. Let him live by your side as your brother. (Vayikra 25:35,36)

The prohibition and its rationale are equally clear: Usury is not immoral per se; it is inappropriate when the borrower is your brother. Brothers do favors for brothers; brothers lend a helping hand, and brothers don’t charge brothers interest.

So much of the book of Vayikra focuses on the holiness of the rites and rituals performed in the Mishkan that we might erroneously conclude that there, and only there, is where holiness resides – until we come to the "surprise ending" of Vayikra. The sudden shift of focus, away from the Mishkan (the precursor of the Beit HaMikdash) and out over all of the Land of Israel, forces us to reconsider the nature of holiness.

Parashat B'har and the laws of the sabbatical and jubilee, usury and familial responsibility, offer a new perspective on holiness; perhaps even more importantly, these laws offer a new perspective on our proximity to holiness and our ability to access holiness and make it a part of our lives. The consequences spelled out for breaching these particular laws – exile – leave no room for doubt: While there are remedies for breaching the holiness of the Mishkan, while those who are in a state of impurity may be distanced from the holy compound, the consequence for failing to respect the sanctity of the sabbatical and jubilee years and the norms of social responsibility they engender is far more dire. The Holy Land will not tolerate such behavior. 

With this understanding, we may approach an answer to the textual problem with which we began: The laws of sabbatical and jubilee observance and the prohibition against usury are prefaced by the unusual reference to Mount Sinai precisely because these laws institutionalize the Sinai experience.

When the Israelites arrived at Mount Sinai, the verses describe the unique experience of unity as a defining moment in our spiritual and national history. In Rashi's words, the nation camped at the foot of Mount Sinai was “as one person with one heart.” (Rashi, Shmot 19:2) The mountain itself was, in that shining moment, the holiest place on earth – and that holiness was later transferred to the Mishkan, and later to the Beit HaMikdash (see Ramban). That is the central theme of the book of Vayikra – up to the first verse of Parashat B'har. When the laws of sanctity of the Land of Israel are linked to Mount Sinai, we understand that the holiness of Mount Sinai is not limited to the Mishkan; it exists in all of the Land of Israel. And when this holiness is framed as the introduction for laws of social responsibility, the other aspect of the Mount Sinai experience, the aspect of unity, becomes much more than a one-time experience. The laws of Parashat B'har teach us to translate that experience into action. Just as the laws transmitted throughout the book of Vayikra teach us that the Mishkan is a recreation of the holiness of Mount Sinai, the laws transmitted in Parashat B'har allow us to recreate the unity we experienced at Mount Sinai and make it a part of everyday life in the Holy Land. 

Living in the Land of Israel is the continuation of the Revelation at Sinai. Holiness is not confined to the Mishkan; it is embodied in every inch of the Land of Israel, and it is rooted in the lives we lead, in our relationships, and in the unity and mutual responsibility with which we conduct our personal and public affairs. While the laws of sabbatical years, jubilee observance, and social welfare are effective tools for building a healthy economy, the rationale behind them goes far beyond pragmatism: Our lives, particularly in the Holy Land, can generate holiness, and we elevate our selves and our society when we treat one another as brothers and sisters should. This is how the holiness of Mount Sinai continues to reverberate and to energize, to uplift and inspire - not only in the Mishkan, but in the lives we live, particularly in the Land of Israel.
